Terms of Agreement
1. Common purpose of terms of agreement
These general terms and conditions (hereinafter referred to as the "Conditions") establish the detailed terms for Sunvolt Limited’s (hereinafter referred to as "Sunvolt") delivery of goods to a consumer (hereinafter referred to as the "Buyer"), as described in the agreement concluded between the Buyer and Sunvolt LLC (hereinafter referred to as the "Agreement"). Unless otherwise agreed in writing, the following general conditions shall apply and take precedence over any general conditions of the Buyer.
2. Scope of services
Sunvolt’'s service consists of the delivery of goods, the specific design, scope, and delivery time of which are described in the concluded purchase agreement/email or other correspondence.
Delivery is usually made by a freight carrier to the nearest curb closest to your address. Sunvolt only delivers to mainland areas and not to non-mainland islands. It is possible to purchase additional freight services, such as a crane truck, if your product needs to be hoisted over a building or similar obstacle.
3. Conclusion of agreement
Final agreement for purchase is considered concluded when the Buyer has signed the purchase agreement, confirmed via email, and paid the deposit. Sunvolt disclaims any responsibility for potential errors and information in materials provided by third parties. This applies to any form of sales material, descriptions, user manuals, content on other websites, etc.
4. Prices and Invoicing
The agreed-upon price for the ordered goods is stated in the documentation provided by Sunvolt. Sunvolt is entitled to invoice the Buyer for payment of the goods prior to delivery.
5. Payment
A deposit of 10% of the purchase amount, with a minimum of [Beløb i pund], is to be paid upon entering the agreement. 80% of the purchase amount is to be paid no later than 3 banking days before installation. The final payment is to be made upon delivery and commissioning of the system. The amounts are to be paid according to the issued invoice.
SUNVOLT RESERVES THE RIGHT OF OWNERSHIP TO THE DELIVERED GOODS UNTIL THE FULL PURCHASE AMOUNT HAS BEEN RECEIVED BY SUNVOLT.
6. Warranty and Complaints
Sunvolt provides a 2-year warranty in accordance with the Sale of Goods and Supply of Services Act for new products, except for Solar GEL (GEL/Lead Acid) batteries, which are considered as regular wear and tear items.
For selected products, the manufacturer offers an extended warranty period, which will be indicated in the datasheet for the specific product. During the first 2 years, we will handle any potential complaints related to these products. If you wish to utilize the extended warranty period thereafter, you should generally contact the manufacturer directly or pay us for handling the matter. If you discover any defects or faults in the product, you must contact SunVolt as soon as possible. It is your responsibility to indicate and, if requested, demonstrate how the defect or fault manifests itself.
Typical indicative manufacturer warranties: 5 years on inverters, 10 years on solar panels, and 20 years on mounting brackets.
Sunvolt is not liable for warranties that go beyond the provisions of the Sales of Goods Act.
Exclusion of warranties on Inverters and Batteries
In case of private/unauthorized login/reprogramming of functions in inverters and associated components, Sunvolt support and warranty obligations are void.
To activate these functions, you must have relevant qualifications and professional expertise in solar power systems and be an authorized partner of Sunvolt.
Changes to the setup and/or configuration of the equipment can/will cause malfunctions, partial failures, damage, and voiding of the grid connection permission from the utility company/energy network.
7. Errors and Defects
Buyer is obligated to inspect and test the delivered goods immediately upon receipt, as thoroughly as necessary, to ascertain whether there are any defects in the goods or if they conform to the order confirmation, both qualitatively and quantitatively.
To claim that the delivered goods have defects (hereinafter referred to as "defects"), the Buyer must notify Sunvolt in writing immediately after discovering or should have discovered the defects. The Buyer must indicate and, upon request, demonstrate how the defects manifest.
Sunvolt is solely responsible for defects that the Buyer has notified immediately after the delivery of the defective goods. Sunvolt is not liable for defects resulting from the design of the goods, provided that the design complies with the agreed specifications. Furthermore, Sunvolt is not responsible for defects resulting from the Buyer's own actions, such as lack of maintenance, improper use, non-compliance with Sunvolt’s instructions, and unauthorized alterations made by individuals not authorized by Sunvolt.
If there are any defects in the delivered goods, Sunvolt may choose to:
a) Rectify the defects,
b) Make replacement or supplementary delivery of the defective goods, or
c) Offer the Buyer a proportionate price reduction.
In cases where it is reasonably assessed that the Buyer can carry out the rectification, the rectification is considered completed upon sending a defect-free part and/or instructions for the rectification. If Sunvolt chooses to rectify, make replacement, or supplementary delivery, Sunvolt is obliged to carry out such actions with the required speed and at its own expense.
If Sunvolt fails to rectify, make replacement, or supplementary delivery within a reasonable time as required by the circumstances, the Buyer may, in writing, grant Sunvolt a final and reasonable deadline to carry out the rectification, replacement, or supplementary delivery. The deadline must be a minimum of 5 working days and may not expire earlier than 20 working days from the time Sunvolt received the Buyer's written complaint regarding the defect. If Sunvolt fails to take action within the deadline, the Buyer is entitled to a proportionate price reduction corresponding to the defective part of the delivered goods compared to the total delivery and price.
If the defect is substantial, the Buyer may terminate the agreement concerning the defective part of the goods. The Buyer may only terminate the Agreement concerning non-defective goods if they are so connected to the defective goods that they cannot reasonably function satisfactorily on their own.
The Buyer cannot make claims for any product defects against Sunvolt unless Sunvolt can obtain reimbursement from the manufacturer. If the Buyer has complained about defects, and it turns out that there are no defects attributable to Sunvolt, the Buyer must reimburse Sunvolt for the expenses incurred in connection with the complaint, including investigation and transportation costs.
Handling of Complaints:
Any errors or defects in the delivery from sunvolt.ie must be claimed within a reasonable time after the Buyer has discovered the error. It is the Buyer's duty to indicate and, upon request, demonstrate how the error or defect manifests. If the Buyer discovers an error, the Buyer must quickly contact [support mail]. If the Buyer lodges a complaint within two months after discovering the defect, the complaint will be considered timely. The rules on defects of the Sale of Goods and Supply of Services Act apply to product purchases. All products have a 24-month warranty unless otherwise stated.
In case of a legitimate complaint, the Buyer can choose between having the product repaired, replaced, a price reduction, or a full refund, depending on the specific situation. The Buyer must send an email with pictures and a description of the problem to [support mail]. It is a requirement that the complaint is legitimate, and the defect has not arisen due to improper use of the product or other damaging behavior.
If the complaint is legitimate, all shipping costs for the Buyer will be refunded.

IMPORTANT: We do not accept returns sent with cash-on-delivery or without delivery service. The product must be returned in secure packaging with a receipt for shipping costs, so that we can refund the Buyer's expenses.
The Buyer must be at least 18 years old to shop on sunvolt.ie - if the Buyer is under 18 years old, the Buyer must have consent from their parents/guardian. 8. Delivery and Transfer of Risk
The indicated delivery time is only indicative for Sunvolt unless otherwise agreed in writing. If a fixed delivery time has been agreed upon, Sunvolt has the right to an extension of the deadline in the following cases:
a) Force majeure according to point 13
b) Delay caused by Sunvolt suppliers, carriers, or other third parties
c) Unusual weather conditions
d) Labor disputes regardless of the cause
e) Public orders or prohibitions that Sunvolt could not have foreseen at the time of the agreement.
Where delivery is agreed to be made to the Buyer's address or another location specified by the Buyer, the goods will be delivered as close to the designated location as a truck, according to the driver's judgment, can safely navigate without getting stuck or damaging the vehicle or surroundings. The Buyer is obliged to inspect the received goods and provide the necessary personnel for unloading. If the Buyer fails to fulfill the aforementioned obligations, Sunvolt will be entitled, but not obligated, to make delivery with discharging effect at the delivery site, regardless of whether a representative of the Buyer is present.
The risk of the goods being lost or damaged transfers to the Buyer upon delivery. The delivery note or the carrier's waybill serves as documentation of delivery. Expenses for any waiting time during unloading at the Buyer's address or another designated location specified by the Buyer are covered by the Buyer, just as the Buyer covers any costs resulting from the Buyer's inability to receive the goods at the agreed delivery time.
9. Complaints and Liability for Delay
The Buyer must notify in writing immediately upon discovering any delay, as the Buyer otherwise forfeits any claim due to the delay. In the case of minor delays, a supplementary delivery will be made. In the event of a substantial delay, the Buyer is entitled to cancel the order. If there is an agreement for progressive delivery, the Buyer is only entitled to cancel the delayed partial delivery. The Buyer is not entitled to any compensation due to Sunvolt’s delay. This applies regardless of whether the Buyer cancels the purchase or retains it.
10. Product Liability
Sunvolt is liable according to the Liability for Defective Products to the extent that the law imposes such liability on Sunvolt for damages, and Sunvolt’s liability is not legally limited. Sunvolt is also liable for damages caused by products supplied by Sunvolt to the extent that the damage is due to gross negligence on the part of Sunvolt, and Sunvolt’s liability is not legally limited.
In cases where Sunvolt is liable for product damages but the damage can also be attributed to errors committed by the Buyer, the responsibility is distributed according to the degree of fault exhibited.
To the extent that Sunvolt may be held liable for product damages in relation to third parties, the Buyer is obliged to indemnify Sunvolt for any liability exceeding Sunvolt’s liability under the above provisions. The Buyer is required to be sued/joined in the same court/arbitration that handles claims for compensation against Sunvolt by third parties in connection with products delivered by Sunvolt through the Buyer to third parties.
Sunvolt shall never be liable for loss of profits, loss of earnings, or any other indirect loss.
11. Force Majeure
In the event that delivery, timely delivery, or defect-free delivery is hindered or delayed by events beyond Sunnvolt LLC’s control, including but not limited to labor disputes, operational disruptions, transportation difficulties, or other third-party failures or similar events, Sunvolt may, at its own discretion, postpone delivery or wholly or partially cancel the order without any liability by notifying the Buyer as soon as possible.
12. General Limitation of Liability and Assignment of Claims against Sunvolt’s Suppliers
Sunvolt’s liability cannot, regardless of any proven negligence, include liquidated damages, loss of profits, loss of time, or any other indirect loss, whether the liability is based on general tort rules or any other basis. In cases where Sunvolt’s supplier or other third party is liable for Sunvolt’s delays or defects, Sunvolt is willing to assign to the Buyer any claims it may have against the supplier or third party.
13. Confidentiality
In connection with the execution of the Agreement, both parties may have access to confidential information and other confidential material from each other. Both parties undertake that they, as well as their employees and subcontractors, will treat the received information as confidential. This provision remains in effect indefinitely. In addition to this provision, other provisions regarding confidentiality and trade secrets under Irish law also apply.
14. Interpretation and Amendments
These terms and conditions apply unless explicitly and in writing deviated from in writing between the Buyer and Sunvolt. Subsequent deviations from the Agreement or the Terms and Conditions can only be made through the issuance of a new agreement or a written addendum to the Agreement. The Terms and Conditions may be revised and/or changed by Sunvolt at any time. However, any agreements already entered into will not be affected by such revisions or changes.
15. Choice of Law and Jurisdiction
Disputes between the parties arising from the Terms and Conditions, the Agreement, or Sunvolt’s services in general, and which cannot be resolved amicably between the parties, shall be settled in accordance with Irish law by the ordinary courts at Sunvolt’s current place of business, currently at the district court in Dublin.
